CREATE AN ILLEGAL MEDIA WORK

EYESEEYOU was produced in fulfillment of a project that required the end product to straddle the law. I chose the topic of privacy in public spaces using the municipal codes governing conduct in the subway trains, specifically unsolicited and unscheduled videotaping and photographing of strangers in the subway. I used the popular Philip-Lorca DiCorcia case, Nussenzweig v. DiCorcia, as precedent for my project in addition to scrutinizing the only document that regulates photography in the subway, the MTA Rules of Conduct Section 1050.9. Although there have been arrests made because of photography in the tunnels, there are no laws that govern privately capturing the images of others in public spaces without their consent.
